The Government is seeking stakeholder views on exposure draft legislation that increases the rights of small businesses to contest the ATO’s collection of disputed tax debts. The draft legislation would allow small businesses to apply to the Administrative Appeals Tribunal (AAT) to pause or modify ATO debt recovery actions where the underlying tax assessment is under dispute in the Small Business Taxation Division (SBTD) of the AAT.  This measure was originally announced in the 2021-22 Budget.

The exposure draft legislation and explanatory memorandum are available on the Treasury website and interested parties are invited to comment. Submissions close on 19 January 2022.
