Northern Territory

There are a range of services available in the Northern Territory to help resolve business disputes.

Community Justice Centres

The NT Community Justice Centres (CJC) provide free mediation services to the community to help people resolve their own disputes without legal action. The CJC can assist with a wide range of disputes including small claims and civil matters.

Northern Territory Courts

The Northern Territory court system is made up of the Magistrates Court and the Supreme Court. In the Magistrates Court civil and commercial matters are heard in the Local Court.

The most appropriate service for your dispute will depend on its value. Disputes under $10,000 are heard in the Small Claims jurisdiction of the Local Court, claims up to $100,000 are heard in the Local Court and claims over $100,000 are heard in the Supreme Court.

Building and Construction

In the Northern Territory,  there is a security of payment law which ensures that a person undertaking construction work in the state is entitled to receive, and is able to recover, progress payments for work they carry out under a written or oral construction contract, including the supply of good and services.

In the Northern Territory small claims, those under $10,000, are able to be determined through the Community Justice Centre 1800 000 473; cjc@nt.gov.au; www.cjc.nt.gov.au.

For disputes with a value in excess of $10,000 you can apply for adjudication to assist you to resolve your dispute by contacting an Authorised Nominating Authority (ANA). Find a registered ANA in the Northern Territory.

 

Energy

Power Water Corporation is a NT Government body, as such complaints and disputes can be investigated by the Ombudsman NT. The Ombudsman’s services are free and impartial.

Before making a complaint, the Ombudsman encourages businesses to take all possible steps to resolve the concerns directly with the relevant government department or local council and will not normally investigate an issue until this has been done.

Fair Trading

Northern Territory Consumer Affairs is responsible for administering and enforcing fair trading laws in the Northern Territory, including the Australian Consumer Law.

Consumer Affairs provides information to help businesses to understand the Australian Consumer Law, how it applies to their business and their obligations when dealing with customers.

The Ombudsman NT offers a free and impartial complaints resolution service for disputes with or complaints about Northern Territory government agencies or local councils in the Northern Territory.

Retail Lease

Northern Territory Consumer Affairs is responsible for retail and business tenancy matters in the Northern Territory. The Tenancy Unit within Consumer Affairs provides services to tenants and landlords of commercial properties in the Northern Territory.

Under the Business Tenancies (Fair Dealings) ACT, the Commissioner of Business Tenancies can mediate disputes between tenants and landlords.

To apply for mediation you must complete an Application to the Commission of Business Tenancies for Determination of Retail Tenancy Claim.

Unfair Contract Terms

The Office of the Australian Small Business and Family Enterprise Ombudsman is a concierge for dispute resolution services.  The Office assists small business operators to resolve complaints and disputes, including disputes with a Commonwealth Government agency, contract and payment disputes and unfair contract term disputes.
